COMPREHENSIVE ADVISING PACKAGE SERVICE AGREEMENT

David Wingard 1-on-1 College Advising
This Service Agreement (“Agreement”) is entered into by and between David Wingard (“Company”), and the individual student/parents(“Participants”) enrolling in the 1-on1 College Advising (the “Services Package”).
By enrolling in 1-on-1 College Advising , Participants agrees to the following terms and conditions:
1. Services Package Description
David Wingard’s 1-on-1 College Advising Comprehensive Package provides personalized guidance for Students as they navigate their college selection, application and athletic recruiting journeys. This package includes monthly scheduled sessions and covers up to 45 hours of service time, both online and offline, including preparation services and unscheduled Q&A sessions.
2. Services Term, Billing and Cancellation
Services will be provided upon enrollment of agreement up until June 30th of the Student’s Senior Year of High School. Payment of services will be collected on monthly billing cycles based on grade level upon signup. A discount of 10% will be applied for a single upfront total payment in full forgoing monthly payment options. Total payments over the term of agreement will total $6,500 for the Comprehensive Advising Package. There will be no refunds issued for previously collected payments and services provided.

4. Responsibilities of Student
- Put full effort into the process
- Cooperate fully with the Advisor
- Keep Appointments
- Meet deadlines for application requirements
5. Responsibilities of Parents
- Support Student throughout the process
- Assist in keeping Student on task
- Allow the Student to take the lead in the College Discovery, Application and Recruiting processes
6. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any damages, including direct, indirect, incidental, special, or consequential damages or losses, arising from the advising services or reliance on any information provided.
7. Indemnification
Participants agrees to indemnify, defend, and hold harmless the Company, its owners, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from the Participant’s use or misuse of the Services or violation of this Agreement.
8. Intellectual Property
All Advising content, including but not limited to videos, slides, templates, and worksheets, is the exclusive intellectual property of the Company. Participants may use the materials for their individual college selection, application and recruiting only and may not reproduce, share, distribute, or create derivative works without the Company’s express written consent.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
10. Entire Agreement
This Agreement constitutes the entire understanding between the parties regarding the Services and supersedes all prior or contemporaneous communications.
By enrolling in the Services Package, Participant acknowledges that they have read, understood, and agree to be bound by the terms of this Agreement.
